1. The Service
Triporto provides a SaaS platform for logistics management. Our software integrates with third-party Electronic Logging Device (ELD) providers to centralize your fleet data.
- No Navigation: We do not provide turn-by-turn navigation or routing. Any maps or location data provided are for informational tracking purposes only.
- Driver Responsibility: Drivers are 100% responsible for the safe operation of their vehicles and must follow all posted road signs and law enforcement instructions regardless of information displayed in the app.
2. Third-Party Integrations (ELD Data)
Our service relies on data pulled from your third-party ELD provider.
- Accuracy: We are not responsible for the accuracy, completeness, or timeliness of data provided by your ELD hardware or service.
- Connectivity: We are not liable for service interruptions caused by your ELD provider's API or hardware malfunctions.
3. Account Types & Permissions
- Fleet Managers: Can invite Operators (Owner-Operators or Company Drivers) to join their dashboard.
- Consent: By inviting an Operator, the Fleet Manager represents that they have the legal right or driver consent to view that Operator's data.
- Data Visibility: Operators acknowledge that by accepting an invitation, their location and compliance data will be visible to the inviting Fleet Manager.
4. Data Retention & Deletion
- Retention Period: We retain your business and compliance records for 4 years to assist with IFTA audits and legal record-keeping.
- Post-Cancellation: If you cancel your subscription, your account will enter a "Deactivated" state. You will have 30 days to export or download your data. After this period, we may restrict access to the dashboard, though records will be maintained in our archive for the duration of the Retention Period.
5. Limitation of Liability
Triporto is a software provider, not a motor carrier or broker.
- No Cargo Liability: We are not liable for lost, stolen, or damaged freight.
- No Accident Liability: We are not liable for any vehicular accidents, injuries, or fatalities.
- Cap on Damages: Our total liability for any claim is limited to the amount you paid us in the 12 months prior to the claim.
6. Fees & Payment
- Subscription Fees: You agree to pay the fees associated with your plan. All fees are quoted in USD and are non-refundable.
- No Refunds: All sales are final. We do not provide refunds or credits for partial months of service, nor do we provide refunds for accounts that were active but not utilized.
- Billing Disputes: Any disputes regarding charges must be submitted in writing to billing@triporto.com within 30 days of the charge date. Failure to do so waives your right to dispute the charge.
